TERMS OF SERVICE
Commissions and Freelance Projects

These terms of service (the “Terms of Service”) govern the use of Kailani Piñon’s (Kailani) commissioned products. By purchasing graphic design assets, original artwork, or other items offered by Kailani’s official ecommerce channels, you indicate that you have read and understand the Terms of Service and agree to abide by them at all times.Payment:

Art and design services will NOT be provided if the entire payment owed is not received. Partial refunds may be issued for project cancellations under certain conditions.Cancellations and Refunds:
Both Kailani and clients have the right to cancel commissioned products regardless of the current progress or status of the commissioned product.Partial refunds may be granted and returned to clients if (1) commissioned products are cancelled mid-development or (2) deliverables are unable to be received. The sum of partial refunds varies with cancellation circumstances and is at the discretion of Kailani to determine the appropriate amount. Partial refunds are intended to compensate Kailani for time and labor costs.Full refunds are only available if Kailani is unable to start a commission.Production:
Kailani will review the written descriptions, reference images, or other beneficial design specifications provided by clients. Kailani will then approve projects according to her Terms of Service and availability. After receiving the full payment, a receipt will be sent to clients, and Kailani will begin the design production.Clients may expect 1–5 reviews with opportunities to provide design feedback and considerations on the presented drafts. While the maximum quantity of client reviews is no more than 5, the total quantity of overall check-ins depends on the complexity and feedback of the designs. The average production duration (the “turnaround time”) may vary from 1–8 weeks.Specifications and Limitations:Chibi Portraits:

🚫 Clients do NOT hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
🚫 Clients do NOT hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.Deliverables:
A notice of completion will be sent by Kailani via email upon the conclusion of the project. Clients will receive a Google Drive link containing digital files of their commissioned product. Clients are advised to download and store files locally for perpetual access. Kailani may resend links or files upon client request within the first two weeks of completion if issues occur, but Kailani is NOT responsible for long-term storage of files.
